Waiver and Release of Liability - Read Before Registering

WAIVER AND RELEASE OF LIABILITY 

READ BEFORE REGISTERING

IN CONSIDERATION of myself and/or child and/or legal guardian being permitted to participate in any way in any activity with Supreme Court Pickleball and Host Facility, including, but not limited to, Supreme Court Pickleball matches, related events or any other activities facilitated by Supreme Court Pickleball and Host Facility (“Activity"), I, on behalf of myself,  my child, my legal guardian, my personal representatives, assigns, heirs, and next of kin, by attending or registering,  the undersigned acknowledges, appreciates, and agrees that:

1. ACKNOWLEDGE, agree, and represent that I understand the nature of the Activity and that myself and/or child and/or legal guardian are qualified, in good health, and in proper physical condition to participate in such Activity. I further agree and warrant that if at any time myself and/or my child’s and/or my legal guardian’s ability to continue to engage in such Activity, I will immediately discontinue myself and/or child’s and/or legal guardian’s further participation in the Activity.

2. FULLY UNDERSTAND THAT: (a) THE ACTIVITY INVOLVES RISKS AND DANGERS OF SERIOUS BODILY INJURY, INCLUDING PERMANENT DISABILITY, PARALYSIS, AND DEATH ("RISKS"); (b) these Risks and dangers may be caused by myself and/or child’s and/or my legal guardian’s own actions or inactions, the actions or inactions of others participating in the Activity, the condition in which the Activity takes place, or THE NEGLIGENCE OF THE "RELEASEES" NAMED BELOW; (c) there may be OTHER RISK AND SOCIAL AND ECONOMIC LOSSES either not known to me or not readily foreseeable at this time; and I FULLY ACCEPT AND ASSUME ALL SUCH RISKS AND ALL RESPONSIBILITY FOR LOSSES, COSTS, AND DAMAGES myself and/or child and/or legal guardian may incur as a result of his/her participation in the Activity.

The risks of injury and illness (e.g., communicable diseases such as MRSA, influenza, and COVID-19) from the activities involved in this program are significant, including the potential for permanent paralysis and death.

While particular rules, equipment, and personal discipline may reduce these risks, the risks of serious injury and illness do exist.

I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEES or others and assume full responsibility for my participation.

3. Compliance with Terms and Conditions

I willingly agree to comply with the stated and customary terms and conditions for participation.

If, however, I observe any unusual significant hazard during my presence or participation, I will remove myself from participation and bring such to the attention of a league ambassador, facility director, or team captain immediately.

4. Release and Hold Harmless

I, for myself and on behalf of my heirs, assigns, personal representatives and next of kin, HEREBY RELEASE, DISCHARGE, AND COVENANT NOT TO SUE SUPREME COURT PICKLEBALL AND HOST FACILITY and all of its affiliated companies, its respective administrators, organizations, directors, agents and/or employees,, officers, agents, managers, members, volunteers, other participants, any sponsors, advertisers, and, if applicable, owner and lessors of premises on which the Activity takes place, (each considered one of the "RELEASEES" herein)  

WITH RESPECT TO ANY AND ALL INJURY, ILLNESS, DISABILITY, DEATH, FROM ALL LIABILITY, CLAIMS, DEMANDS, LOSSES, OR DAMAGES ON MY ACCOUNT CAUSED OR ALLEGED TO BE CAUSED IN WHOLE OR IN PART BY THE NEGLIGENCE OF THE "RELEASEES" OR OTHERWISE, INCLUDING NEGLIGENT RESCUE OPERATIONS, WHETHER SUCH LIABILITY WOULD OTHERWISE RESULT IN LOSS OR DAMAGES TO MYSELF, MY CHILD, MY LEGAL GUARDIAN OR THE RESPECTIVE PERSONNEL REPRESENTATIVE, HEIRS OR NEXT OF KIN, AND I FURTHER AGREE that if, despite this RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT I, or anyone on my behalf, makes a claim against any of the Releasees, I WILL INDEMNIFY, SAVE, AND HOLD HARMLESS EACH OF THE RELEASEES from any litigation expenses, attorney fees, loss, liability, damage, or cost which may incur as the result of such claim.

5. USE PERMISSION. I also give Supreme Court Pickleball and Host Facility or Supreme Court Pickleball and Host Facility’s third-party operators and their agents and designees permission to use or distribute, without limitation or obligation, my image, name, voice, and words for any purpose connected with the Activity, including promotional, marketing, training, informational, and archival uses.

6. I agree that this Waiver and Use Permission shall remain in full force from the date of my signature until I revoke said Waiver and Use Permission by providing written notice to Supreme Court Pickleball and Host Facility LLC.

I HAVE READ THIS AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT AND HAVE SIGNED IT FREELY AND WITHOUT INDUCEMENT OR ASSURANCE OF ANY NATURE AND INTEND IT TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW AND AGREE THAT IF ANY PORTION OF THIS AGREEMENT IS HELD TO BE INVALID THE BALANCE, NOTWITHSTANDING, SHALL CONTINUE IN FULL FORCE AND EFFECT.

By registering for and participating in the Supreme Court Pickleball matches, I acknowledge that I have read, understand, and agree to the terms of this Waiver and Release of Liability.

About Supreme Court Pickleball:

Supreme Court Pickleball is the only competitive pickleball league in the Dallas metroplex integrating with DUPR. Founded in 2024, by players. The league brings together recreational pickleball players of all skill levels from across the region to compete in an organized, community-driven format. The league fosters a keen sense of camaraderie and sportsmanship among its players. By facilitating matches that consider each player's skill level integrated with DUPR, Supreme Court Pickleball ensures fair and enjoyable competition for players. Teams are formed through individual effort at public and private facilities. Fees are charged to participate in league play, tournaments, and social events. 

At the heart of Supreme Court Pickleball are our players, facilities, and team captains. Their experience ranks first!! Supreme Court Pickleball partners with the majority of the top pickleball facilities, centers, and country clubs, both indoor and outdoor, in the Dallas metroplex to provide well-maintained courts and lighting for an outstanding player experience. By rotating match locations, the league provides players the opportunity to play at various venues, experience their amenities, and play different opponents. Each bracket winner will face off in a championship match for an exciting finale for Supreme Court Pickleball Championship status.

The league is powered by volunteers and comprised of players from every almost industry in the Dallas Metroplex united by their passion for the game. Providing many opportunities for social and professional networking expansion across the Dallas Metroplex.

Through our league, we aim to give back to local organizations and causes that make a positive impact. We are in the process of establishing Supreme Court Pickleball as a non-profit sports organization. This will allow us to donate a portion of our funds to support important initiatives and programs in our communities.
